Ripple filed last December 2 a final objection with the Southern District of New York court regarding a request for a summary judgment in a lawsuit against the SEC over the status of XRP.
The document reads:
“The court must grant the defendant’s motion and deny the SEC’s motion.”
The company’s general counsel, Stuart Alderoty, has called the regulator “bouncing,” citing two agency statements that he believes contradict each other.
He has previous said that “after two years of litigation,” the SEC “could not prove that XRP met a single item on the Howie test.”
