ARK Invest Files Amended ETF Application

ARK Invest has successfully submitted its final Form S-1 amendment for its proposed Bitcoin exchange-traded fund (ETF), becoming the first company to do so in order to be considered for approval in the first wave of decisions in January 2024, as required by the United States Securities and Exchange Commission (SEC).

According to sources, representatives from at least seven firms were informed by the SEC on Dec. 21 that they needed to submit their final S-1 amendments by Dec. 29.

Attendees at the meeting were reportedly told that those who failed to meet the deadline would not be included in the initial group of spot Bitcoin ETF approvals in early January.

ARK Invest met the deadline, filing an amendment to the S-1 registration statement for its Ark 21Shares Bitcoin ETF on Dec. 28.

This amendment reportedly focused on authorized participants, which are designated participants who can create and redeem shares of an ETF.
